Article 1 — Purpose

These Terms of Service (ToS) govern the use of the Olowave platform, accessible via the website olowave.com and the Olowave mobile application (hereinafter "the Platform"), operated by Olowave.

By accessing the Platform or creating an account, you accept these Terms of Service in full.

Article 2 — Definitions

• Olowave: the company operating the Platform.
• User: any person accessing the Platform, whether registered or not.
• Account: personal space created by the User to access the Platform's features.
• Content: any data published by a User on the Platform (polls, comments, votes, media, etc.).

Article 3 — Registration and access

Registration is free and open to anyone aged at least 13 years, subject to parental consent for minors according to applicable laws in their country of residence.

The User undertakes to provide accurate information and keep it up to date. Any identity theft, unauthorized multiple account creation, or fraudulent use will result in immediate account suspension.

Article 4 — How the Platform works

Olowave allows Users to create, share, and vote on polls on topics of their choice. Polls can be public or private, and certain content may be subject to moderation.

Article 5 — User obligations

The User agrees to:

• Comply with applicable laws and regulations;
• Not post illegal, defamatory, hateful, racist, sexually explicit content about minors, or content infringing third-party rights;
• Not use the Platform for commercial purposes without prior agreement from Olowave;
• Not attempt to circumvent technical security measures.

Article 6 — Intellectual property

The User retains ownership of the content they publish, but grants Olowave a non-exclusive, worldwide, free license to display, reproduce, and adapt it as part of the Platform's operation.

The Olowave brand, logo, design, and all graphic elements are the exclusive property of Olowave.

Article 7 — Personal data

Personal data processing is governed by our Privacy Policy, compliant with GDPR and applicable laws.

Article 8 — Liability

Olowave makes every effort to ensure the availability and security of the Platform but cannot be held liable for interruptions, data loss, or indirect damages resulting from its use.

The User is solely responsible for the content they publish.

Article 9 — Suspension and termination

Olowave reserves the right to suspend or terminate a User's account in case of violation of these ToS, without notice or compensation.

The User can delete their account at any time from the application settings.

Article 10 — Modification of ToS

Olowave reserves the right to modify these ToS at any time. Any substantial modification will be notified to Users, who will have to accept the new version to continue using the Platform.

Article 11 — Applicable law and jurisdiction

These ToS are subject to French law. Any dispute shall fall under the exclusive jurisdiction of French courts, subject to mandatory provisions applicable to consumers.
